An Ikeja High Court has dismissed Mohbad’s father’s case against Naira Marley and Sammy Larry.
Mr. Aloba had challenged the legal advice that cleared Naira Marley and Sam Larry in the Mohbad case.
Justice Taiwo Olatokun ruled the Attorney General holds exclusive powers to prosecute or not prosecute any suspect involved.
Aloba, through counsel Wahab Shittu (SAN), claimed the DPP’s legal advice violated fair hearing in the Mohbad case.
He argued that releasing the advice preempted the coroner’s inquiry, which remains ongoing and yet to conclude.
He added that Marley and Larry’s premature clearance undermined the ongoing investigation into Mohbad’s cause of death.
Responding, the state argued they dismissed—not acquitted—the suspects, following legal review of the Mohbad case file.
The government said the DPP had no obligation to inform the inquest before issuing its final legal advice.
Justice Olatokun maintained the Attorney General’s prosecutorial discretion cannot be challenged or influenced by any private party’s opinion.
He affirmed the coroner’s inquest operates independently and may arrive at different conclusions after its final assessment.
This judgment deals a heavy blow to Mohbad’s family, who continue seeking answers over his sudden death.
Mohbad’s fans have consistently called for transparency and accountability throughout every stage of the legal and investigative process.
